Helio Builders operates as a solar advocacy company. Through our HelioGold Solar brand, we act as an independent advocate for consumers navigating the solar installation process — helping clients evaluate options, understand pricing, and connect with qualified installers. Through SolarBids.com, we facilitate connections between consumers and solar installation professionals. We do not install solar panels ourselves; we represent the interests of the consumer, not any single installer.

Additional brands and properties operated by Helio Builders may be introduced from time to time and will be governed by these same Terms.

2. Use of Our Services

You agree to use our websites and services only for lawful purposes and in accordance with these Terms. You agree not to:

• Provide false or misleading information in any form submission.
• Use our services in any way that violates applicable federal, state, or local laws or regulations.
• Attempt to gain unauthorized access to any portion of our websites or systems.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of our services.

3. SMS / Text Message Communications

3a. Marketing SMS

By opting in to marketing text messages, you consent to receive promotional communications from Helio Builders DBA HelioGold Solar, including special offers, discounts, and service updates, at the phone number you provided. This consent is not a condition of any purchase.

3b. Non-Marketing / Critical SMS

By opting in to non-marketing text messages, you consent to receive operational and transactional communications from Helio Builders DBA HelioGold Solar, including but not limited to: appointment reminders, consultation confirmations, installation status updates, project milestone notifications, and other communications directly related to your solar project or service agreement. This consent is not a condition of any purchase.

3c. Opt-Out & Support

You can cancel SMS service at any time. Simply reply STOP to any message from us. After sending STOP, we will send a one-time confirmation that you have been unsubscribed. You will no longer receive SMS messages from us unless you re-enroll. If you want to re-enroll, simply sign up again as you did the first time.

3d. Message Frequency

Message frequency varies based on your interactions with us and the stage of your solar project. You will receive messages as needed to keep you informed. As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

3e. Carrier Liability

Carriers are not liable for delayed or undelivered messages.

4. Forms and Consent

When submitting any form across our websites or brands, please note:

• Providing your phone number is never automatically conditioned on consent to receive marketing or non-marketing text messages.
• Consent checkboxes for SMS communications are always optional and must be affirmatively selected by you.
• We will only contact you via the channels for which you have provided explicit consent.

5. No Warranty

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in San Diego County, California.

We reserve the right to modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
